1) WHAT DEFINITIONS ARE USED IN THIS PRIVACY NOTICE?
1.1) Data protection definitions
Controller means a party that is in charge of the personal data processing activities.
Data subject is a term for a human being in accordance with data protection laws.
GDPR means the EU General Data Protection Regulation (679/2016).
Legal basis for processing means the legal basis with which the controller processes personal data of a data subject. Article 6 of the GDPR contains provisions on legal basis for processing.
Personal data means any data concerning a data subject or data with which a data subject can be identified with.
Privacy notice means a data protection document that has been drafted according to Articles 13 and 14 of the GDPR, and with which the controller may inform its data subjects of the ways their personal data is processed.
Processor means a party that processes personal data for and on behalf of the controller. Profiling means the automatic processing of personal data, in which the personal characteristics of the data subject are assessed using personal data.
Purpose for processing means the reason why the controller processes personal data of a data subject.
1.2) Headhunting definitions
Headhunting means our headhunting business, where we strive to find suitable employees for our clients using public sources and information in our Talent Community.
Potential Candidate means a job seeker or a potential employee candidate who is our data subject. We collect Potential Candidate’s personal data from public sources, and process their personal data for Headhunting purposes. Potential Candidates are not TC Candidates.
Talent Community means the talent community that is developed via our own site where candidates can send their own information for joining our talent community.
TC Candidate means our data subject who has themselves registered into the Talent Community via our website with the intention of being considered as a candidate in Headhunting.

3) IS IDEAL SCOUTING OY ALSO A PROCESSOR FOR THE PERSONAL DATA?
Yes, we act as a processor in certain assignments on behalf of our clients (i.e., employer companies). In these situations, we process the personal data of potential employees so that our clients can contact them themselves. When we act as a processor, we process personal data in accordance with applicable data protection agreements.
4) WHY DO WE PROCESS YOUR PERSONAL DATA?
We process your personal data for the below mentioned purposes of processing. Below you will also find information on what personal data we process and what are the legal basis for our processing activities.
a) Headhunting based on Talent Community information
Explanation: Personal data is processed so that we can perform Headhunting through the Talent Community.
Category of data subjects: TC Candidates
Categories of personal data: Basic information and contact details, general information, employment history, education data, competence information, other possible information made public by the data subject and information provided by the data subject to the Talent Community.
Legal basis for processing when we process personal data of TC Candidates:
(1) Consent of the data subject (GDPR, art. 6(1)(a)), when the data subject decides to send a message via Talent Community contact form.
(2) Consent of the data subject (GDPR, art. 6(1)(a)), when we disclose personal data to employer companies.
b) Headhunting based on public source information
Explanation: Personal data is processed so that we can provide Headhunting to our clients.
Category of data subjects: Potential Candidates
Categories of personal data: Basic information and contact details, general information, employment history, education data, competence information, other possible information made public by the data subject.
Legal basis for processing when we process personal data of Potential Candidates:
(1) Our legitimate interests (GDPR, art. 6(1)(f)), when we collect and process personal data that we have not received from the data subject, as it is necessary for us to run our business. We have assessed our legitimate interest to be lawful with the help of the Finnish Data Protection Ombudsman’s balance test.
(2) Consent of the data subject (GDPR, art. 6(1)(a)), when we disclose personal data to employer companies.
5) FROM WHERE DO WE COLLECT YOUR PERSONAL DATA?
We collect personal data of Potential Candidates and TC Candidates from the data subjects themselves and from different publicly available sources of work life information. In addition, personal data of TC Candidates is collected with contact forms on our website. If we collect your personal data from other sources than yourself, we will separately notify you about this within a reasonable time through email or other similar communication channels. At the same time, we will inform you about your right to demand us to delete the personal data we have collected about you.
6) DO WE DISCLOSE OR TRANSFER YOUR PERSONAL DATA?
6.1) Disclosure of personal data
By default, we do not disclose your personal data to third parties. However, if we are required by mandatory law or authority to disclose your personal data, we will assess the lawfulness of the disclosure on a case-by-case basis. We may disclose your personal data to employer companies provided that you have given your consent to the disclosure.
6.2) Transferring personal data to providers of digital services
We may transfer your personal data to third parties who provide digital services when we use their services, for example data storage service providers (e.g., cloud service providers) and communications services providers (e.g., email service providers). As such third parties are our processors, we ensure that we conclude adequate personal data processing agreements and safeguards in relation to the data transfers.
6.3) Transferring personal data outside the EU / EEA area
Your personal data may be processed outside the EU and the EEA area. In these situations, we ensure an adequate level of data protection, for example through standard contractual clauses and other similar arrangements.
7) DOES OUR PERSONAL DATA PROCESSING ACTIVITIES INCLUDE AUTOMATED DECISION MAKING?
Our personal data processing activities do not include automated decision making.
8) HOW LONG DO WE RETAIN YOUR PERSONAL DATA?
Personal data of TC Candidates are by default stored for six (6) months from the point of time when the data subject has loaded their information to our Talent Community. However, the TC Candidate can always give their consent to extend the storage period for additional six (6) months.
Personal data of Potential Candidates are by default stored for six (6) months from the point of time when the personal data was collected for the first time. However, the Potential Candidate can always give their consent to extend the storage period for additional six (6) months.
9) WHAT DATA PROTECTION RIGHTS DO YOU HAVE?
You may have the right to use the below listed data protection rights under the EU General Data Protection Regulation (679/2016):
– Right to inspect (art. 15)
– Right to rectify (art. 16)
– Right to erasure (art. 17)
– Right to restriction of processing (art. 18)
– Right to data portability (art. 20)
– Right to object (art. 21)
– Automated individual decision-making, including profiling (art. 22)

10) CAN THIS PRIVACY NOTICE BE AMENDED?
We have a unilateral right to modify this privacy notice. We modify the privacy notice whenever necessary, for example in the case of changing legislation. The modifications take effect immediately when we post the up-to-date version of this privacy notice to our website.
If we make significant changes to the privacy notice, or if there is a significant change in the way it is used, we will notify the data subjects.
